This is actually a common misconception; there's no protection (at
least in the US) for merely giving away copyrighted material unless
you're the copyright holder or have been otherwise licensed to do so.

has a relatively good explanation of it. [That's why Creative
Commons,[1] the FSF,[2] and other similar groups have been formed to
try to convince artists and authors to license some of their rights to
everyone, so mixtapes and other creative amalgamations can happen.]
