Senator's Wife to Avoid Prosecution in Mulch Dispute

WASHINGTON (June 2) - The wife of Sen. Max Baucus, D-Mont., reached a deal 
Wednesday to avoid prosecution on a misdemeanor assault charge that stemmed from 
a dispute with another woman in a garden center parking lot.
Under the agreement approved in District of Columbia Superior Court, Wanda 
Baucus, 56, will enter a program for first-time offenders. It was expected to 
include some type of anger management training.
Her attorney, David Schertler, said that once she completes the "diversion 
program," the charges against her will be dropped. She also is expected to 
perform 40 hours of community service.
She told reporters outside the courtroom that she felt good about the 
proceedings.
The senator was at the Mayo Clinic in Minnesota where he had undergone a 
nonsurgical procedure to correct an irregular heartbeat, the hospital said. In an 
earlier statement about his wife, the senator had said, "I stand by her 110 
percent, and she has my full support."
Mrs. Baucus was arrested April 21 after a dispute at a nursery in northwest 
Washington. A police spokesman said she was upset that she wasn't getting help 
loading mulch into her car while another woman was. Witnesses reported seeing 
her put a bag of mulch behind the other woman's car, preventing her from 
leaving. The two exchanged words, and Mrs. Baucus was alleged to have hit the other 
woman several times.
