I'm not so sure. Once you've purchased the comic you can do anything you want to it and you can resell it. But I do not believe you can use it to improve the value of another item and then sell that decorated item without permission. It's not that they have taken an actual coimic that is the issue, it's that they have taken a copyrighted character and used it to sell their cheesy wallets.
I think it really comes down to whether it's enough of a violation for Mark & Sergio to care. As for the Big Boys, it's been my observation that huge corporations take more notice of copyright violations by tiny businesses than other small businesses. But then, other small businesses don't have a battery of attorneys on retainer.

It looks like the wallet-maker is using pages from comic books, and not copies s/he made, so it's not a copyright violation. Sacrilegious to treat books that way, IMO, but probably legal.
