I think the thing is this case is that the mixtapes were being sold, no?

That is a different story than mixtapes being used for promotion.  It is
wrong to sell your mixtapes/cds;  there is no buts about it.  It's selling
something that isnt yours to sell.  It's like selling entrance to your
house to watch The Bad Girls Club on tv.  You must get a license!

Even then, most people who get mixes don't go out and purchase the music
that is on them.  Furthermore, most people don't even know who made the
tracks unless they are brave enough to ask the DJ.  And then, you have the
DJs that don't want to share their playlists.  That is whack in itself.
